Understanding Court Hearings

There are many types of court hearings.  Some types of hearings require the parties’ presence, and some do not.  Set forth below are some of the most common terms which are filed in a divorce matter.  Familiarizing yourself with these terms will help you understand where you are in the divorce process and what to expect if you have to appear in court.

Bailiff A bailiff is a police officer who is assigned to keep order in the courtrom.
 
Bifurcation
A bifurcation is a type of motion which asks the court to grant the divorce before the trial and after six months have gone by.
 
 
Court Clerk
A court clerk is the judge’s assistant. He or she is responsible for making sure the courtroom runs smoothly.
 
Court Reporter
A court reporter records every word said in a court proceeding by way of a transcript.
 
 
Ex Parte
An ex parte is an emergency hearing involving a matter so important that it requires immediate court orders.
 
Expert Witness
An expert witness is any witness who has expertise which the court relies upon.
